Surprise - You're On A Recorded Line, Too!

When you hear that nearly universal announcement at the beginning of conversations, "This call may be recorded or monitored," you need to know several things:

(1) The probability that the call will be used for "training purposes" as some announcements say, is practically, nil. Most companies are so strapped for personnel, so tapped out, so thinly staffed by monitors, coaches, and trainers, that they can barely staff the phones, let alone intrude into calls present, or past.

(2) That announcement is designed more to tame and narcotize callers than to truly govern the quality of conversations. It is saying "Big Brother is Listening to YOU," so dear customer, you should mind your manners.

(3) Merely announcing that the call may be recorded is not sufficient to evoke customer consent. In many states, the law suggests that you must be given an opportunity to say: "I don't want this call monitored or recorded," and to then be able to converse free of eavesdropping, or to be called back on an un-recorded line. If the rep has no way to STOP the recording system, s/he is probably violating your privacy rights, on the spot, especially if you object in a timely way.

(4) Most important, if they are recording you, YOU CAN RECORD THEM!

And you should say so, at the top of the call.

Say, "Hello, this is so-and-so on a recorded line, and I have a little problem..."

By telling them that they are being recorded you are putting them on notice that their service quality is being assessed, that they report to you, and the call had better succeed, or it could be replayed anywhere, to anyone, at any time.

Then, sit back, and simply enjoy the attentive service you receive, perhaps for the very first time!

With the horrible financial crisis of last year, more and more people are becoming afraid of what will happen with their college degree that they worked so hard for. Some people who had college degrees found themselves working at fast food joints because they couldn't find other jobs that were related to what they went into in school. However, there were other people with degrees that have a totally set life because no matter how bad the economy got, they were needed in the professional field. Here are a few of those areas of work.

The medical field. It doesn't matter if no one has any money, people are always going to get sick and hurt which means that you are always going to have a job. Dentists are considered a part of the medical field, but they definitely don't get the same job security that doctors do. So, if you want a job that will always be secure, consider going into the medical field.

Law and politics. Although a few people may have been laid off during the recession, the majority of people in these two fields stayed in a very secure job standing. In times of a recession, the country needs more leadership and more lawyers to take care of the bad things that are going on. These are not luxury jobs that people can't afford, because these are jobs that will always be around. So, another great option to go into when you start working on your degree is either political science or law.

Five Reasons Telemarketing Turnover Is So Rampant Right Now

One of the great disappointments conventional managers and business owners face when they first use telemarketers is the amazing amount of employee turnover.

By comparison, if you want to hire someone to do customer service, especially if they're experienced, you can expect them to be stable. They'll probably last six months or a year or two, at minimum.

Hire somebody on Monday for telemarketing, and if they're still aboard by Friday, throw a party! You just may have someone who will last a month, or wow, even two!

Am I exaggerating?

Sadly, I'm not.

Why is there such turnover?

(1) The economy is strong, unemployment is low, and telemarketing jobs are plentiful. This is a "perfect storm" for recruiters. There aren't many people available who aren't already in the labor force. The ones who are available may be returning after a long absence, or are marginal workers, at best, without drive and discipline and with few skills.

(2) Telemarketing is a grind. To be productive, you have to keep your nose to the grindstone, and for this reason, I suggest shifts be shorter than eight hours. Four to five hours can even be a burnout.

(3) Telemarketing is harder than most people think. Think about the people you know. How many of them would rise to the top in sales, on the phones or off? Frighteningly few, I can tell you.

(4) Telemarketing requires a bigger investment than management ever expected. Like a war gone badly, where men and materiel are consumed at an unimaginable pace, telemarketing units chew up resources quickly, as well. Especially daunting, are the ongoing costs for recruiting and training. Ads in newspapers and online cost a lot, and you have to constantly rewrite them, so your jobs will sound fresh and attractive.

(5) Telemarketing, unless it's being done for a radio or TV station or for a glamorous company or industry, isn't a high status job. People aren't going to confess to doing it, unless it can be packaged attractively; i.e. "I do market research for CSB News Radio, in Los Angeles."

Consider these factors before you leap into doing telemarketing or invest in this area.

The Telemarketing Prayer

You can be the most experienced and best-trained salesperson in the world and still deliver flat, lifeless presentations, while the rookie next to you could sound inspired and break all sales records using a fraction of your skills. Have you ever wondered why you can descend into a slump while they're soaring, defying gravity? Could it be a matter of hope and faith? Are they asking for and receiving help?

I've found that there is an uncanny connection between those times when I've recited a short silent prayer and when I've achieved top results with my sales prospects. Here are some of the things I've asked for assistance with.

I hope this Telemarketing Prayer will help you as much as it has helped me!

Please help me to communicate better than I've ever done before.

Let me be as refreshingly clear as water.

Let me be enthusiastic, showing my commitment to my product and company.

Let me open my ears, to hear the customer and appreciate his or her viewpoint.

Let me be brave enough to strongly and convincingly lead my prospect to buy.

Let me not suffer from sales remorse.

Help me to take comfort in the fact that most people resist buying at first, but are pleased they bought, afterwards. Help me to appreciate that sales are the spark plugs of all business activity. Without sales, businesses and the people they employ can't move forward.

Remind me constantly that there is only one person as important as a salesperson and that is a customer. We need each other, and when we serve each other it is because we have seen that our interests are aligned. We improve each others' lives.

Help me to appreciate that the phone is the best medium for selling. The weather, time, and topography are completely irrelevant. It is always the right time to Reach Out and Sell Someone (TM).

The Day Credibility Workers Lost Credibility

My oft-quoted professor, the late Peter F. Drucker, popularized the phrase "knowledge workers" to define that subset of the service economy's participants, those of us that labor with ideas, instead of bending sheet metal or pasta noodles to our will.

But there is even a narrower guild of toilers to which I belong: "credibility workers."

Not only do we use our minds, as credibility workers. We deploy our credentials, many of them bestowed by universities, degrees that distinguish us and have, historically given us much of our clout and a competitive edge.

We are "faith healers" of a sort, especially those of us that consult. Some of our impact comes from a placebo effect. Clients believe in us and in our advice, and they trust it is superior to what they would have developed for themselves.

And of course, they have confidence our suggestions and strategies will work, will pay-off.

Mere ideas do not garner acceptance, by themselves. Knowledge workers spawn ideas aplenty.

Ideas and concepts need to be promoted, they require charismatic champions, and they must be packaged, attractively. Knowledge workers are notoriously poor self-promoters. (How else can we explain the anomaly of the perennially underpaid teacher?)

Credibility workers, on the other hand, appreciate the wisdom contained in the Cape Cod conversation we had, a number of successful consultants working together on a mammoth and historic U.S. Navy training contract.

The team leader, a seasoned advisor in his own right, declared: "Most consultants are equally competent. The difference is in our marketing skills."

I quibbled when I first heard this remark. But over time, I came to see he was close to the mark. Marketing is crucial to a credibility worker's success.

Which brings me to my point: Today, with the economy in turmoil, credibility workers are in crisis. Unlike any time that I can recall over the past few decades, the attitude toward consultants and advisors of all kinds, lawyers and CPA's included, is one of deep suspicion and even outright contempt.

The bubble of credibility in which so many of us have enveloped and insulated ourselves, has burst.

Let me tell you precisely when this occurred. It was the moment former Federal Reserve Chairman Alan Greenspan conceded that he was "shocked" over the suddenness and severity of the economic meltdown that became apparent in October, 2008.

Dr. Greenspan was one of the most credible economists and public servants America ever saw, and we saw him a lot, testifying to Congress about monetary policy. A word from this most esteemed source, literally, moved markets up and down.

So, for him to admit he was surprised, flummoxed, and out of his depth in witnessing a historic economic event, cast a pall on all advisors, I would argue. Once that happened, Americans seemed rudderless and without a captain and crew; abandoned to the tempests and to the tumultuous tides.

Watching their retirement portfolios sink, and a series of financial gurus being indicted for fraud, they felt not only that they were equally competent to steer their ships, but they were they only ones that truly cared about them.

"Nobody knows anything I don't know," has become a tacit mantra.

Add to this the ease of obtaining online and upstart university degrees, and you can see that a huge revaluation is underway regarding what it is that credibility workers actually know, apart from self-promotion.

President Obama, a former law professor, has noted that degrees no longer signify common standards of knowledge or competence. He recalls how his grandmother's writing, having been learned at the high school level, was vastly superior to the abilities demonstrated by many of his law students, who held undergraduate degrees, many from prestigious institutions.

The crack in Dr. Greenspan's credibility is spreading like fissures from the San Andreas Fault. While he is to be commended for his candor, for admitting he was clueless, he has started a reappraisal that is forcing the rest of us to explain we really DO know more, and what we know, really matters.

Suddenly, credentials and credibility have parted company.

Five Ways To Build Your Sales Confidence

Selling can be difficult, especially for people who have occasional bouts of insecurity and shyness.

One day, they'll be outgoing and worldly, fit and ready to handle whoever comes their way and whatever is thrown at them.

On the next, they'll feel utterly weak and wimpy, and have to find some way to kick start their efforts.

This article is meant to help you with the second sort of day, the one that tries salespeople's souls.

Here are five things you can do, right away, to turn the tide:

(1) Concentrate on the fact that your product or service benefits lots of people; not just you. Visualize people benefiting, their lives improving in some substantial way because you delivered, you put your item into their hands. For example, I'll never forget the time that a Northern California client said, "Thank you for being so persistent!" after I finished doing some seminars for her customer service people. She knew that I went out of my way to stay on her about doing the programs, and she was happy I did!

(2) Tell yourself that whatever cloud you're operating under will soon pass, and it will go away faster if you busy yourself with constructive activity.

(3) Get something minor done, of which you can be proud. For instance, let's say you have a list without any contact names on it. Call those companies, seeking only those names, noting them when you obtain them.

(4) Tell yourself, "Every day, in every way, I'm getting better and better!" It may feel untrue, but our greatest growth comes when we least notice it.

(5) Do something you have been putting off. Once you get the edge on a procrastination item, you can feel so energized that everything else seems easy to hurdle.

Slumps, mood swings, and disappointments are things we all have to face, from time to time. The real winners continue to progress, even in the face of these challenges, by doing whatever they can, to change the tide.

From how we carry our groceries to the car to washing clothes on the cold cycle, even the smallest things in our daily lives has been affected by the 'green movement.' Environmental issues like the global warming and the oil spill are on everyone's minds which has created a growing trend in the world of environmental law.

Legal minds of all ages and backgrounds are looking towards including environmental law to their skills. Although it is currently a growing field for lawyers, it is anything but new. Going as far back as the 1960s and 70s, you can begin to see the hallmarks of what is fundamentally environmental law with the passage of statutes that regulated land use and protected National Parks. And that was just the beginning. Today, the sector works to create statutes on a wide range of policy issues, including land protection and development, pollution control, and resource conservation and management.

Once considered a 'niche' practice area, environmental law has blossomed into a massive body of law that touches on many and various social issues. Online Law School - It is Not Harvard, But it is What You Do With Your Degree That Counts

If you have decided to obtain an online law school degree, do not think that it will be a push over. There is not a single university that takes the practicing of law lightly. You will still have to spend long hours studying and memorizing the law.

At the present time, only the state of California permits students that have been educated in law online to take the bar examination. You will have to either be living in the state or willing to relocate to obtain your license on the chance you pass the bar examination as part of the requirement.

You must have also completed a minimum of 60 course hours of credit at the college level with a GPA at or above the minimum requirement to graduate.

To qualify for the examination, you must also have completed 864 hours of study and preparation per year with a registered online law school. You also must be a registered law student.

There is a first year test that must be passed that includes the basics of law like contracts, criminal law, and the basic concepts of law or torts that all 1st year law students are exposed to and are required to know. This is a four hour test that is given twice a year.

All lawyers in California are required to be of good moral standing and this must be proven to the committee by having an evaluation of yourself that could include a background check.

Another test that must be passed is the Multistate Professional Responsibility Exam that is 2 hours and 5 minutes long. There are 60 multiple choice questions that cover representing clients, privileges, and contempt of court issues. This exam is given twice a year.

Once all the requirements are met for graduating, the bar exam must be taken and passed. This exam is given over the course of three days.

Obtaining an online law school degree is unlike any other education. This is not for the faint of heart.

Exactly How Smart Are You? And Does it Matter?

I'm a fairly competitive guy so when one of my salespeople challenged me to literally match wits with him, I rose to the bait.

"What's your I.Q., Gary?"

"I dunno."

"No, really, what is it-Have you ever been tested?"

"In school I took some exams and they said I was a classic underachiever, so I suppose they wouldn't bother saying that to a dunce."

"You should have it tested."

"Why, Barry, do I need an I.Q. test, when my job as a manager is to deal with bozos like you?"

"I just joined Mensa," he went on, "You know, the genius society, and if your I.Q. is over 130, you can join, too! All you have to do is take an I.Q. test."

This was one of those weird conversations in which you don't want to go on with it, but at the same time, you can't stop.

"Barry, where would I get an I.Q. test?"

"Mensa will test you, or you could take one at the university. They'll accept that, too."

He was right. The Counseling Center at school administered all kinds of tests, so I could probably get tested for free. Plus, if I turned out to be a certified simpleton, no one would be the wiser, but me.

Sometime during the next week, I popped into the Center and asked for a test and they said I'd have to see a counselor, first. What a waste, I thought, but my quest was important enough to slay a dragon or two along the path.

A suitably somber, bespectacled psychologist asked me why I wanted to know my I.Q., and I told him about Barry, Mensa, and my long time personal curiosity.

At the end of our chat he decided NOT to give me what I asked for, but instead to give me a vocational guidance instrument that informed me I would be great at real estate sales and make a very disgruntled forester.

His reason for withholding the I.Q. test was this: What if I discovered I was a genius? What, then? Would I just hang around feeling superior while squandering my gifts?

And if I were a dim bulb, what would I do? Would I use this discovery as an excuse to feel inferior, and as a perfect justification not to try hard to achieve challenging goals?

Having bought into the logic of the counselor, I never bothered to take an I.Q. test.

Instead, I went on to earn five degrees, to teach on the regular faculty at three universities, to teach in continuing education at 40 more, and to write some best-selling books.

If my subconscious goal was to prove I was smart, perhaps it would have been more efficient to have found another place to have taken that test!

The Second Year of Law School - 5 Things to Do!

Well, you survived your first year of law school and hopefully spent the summer gaining meaningful experience in a legal setting - be it an internship with a judge, clerking for a law firm or working as a student attorney for a legal clinic. Now it's time to embark on another year in law school. Here are 5 things to know going into your second year of law school:

1. Join Law Review. This is the most prestigious law school publication you can write for and you should definitely try to write on if you are not automatically invited based on your first year law school grades. It's amazing how many more doors will open for you simply based on having your school's law review publication on your resume - even more if you are editor! Although practicing law has nothing to do with writing a scholarly note or article (you'll be writing legal briefs and motions!), law firms have a special affinity for those who wrote for law review. But it's more than just a career-boosting opportunity; it's a chance to really develop your skills as a writer and show commitment to scholarly publication, which is definitely useful for those who eventually would like to teach or become an authority figure in a particular area of law. If you cannot join law review, see about joining another law journal publication offered at your school. While it won't carry the same prestige that law review has, it will, nevertheless, be a very beneficial experience for the reasons noted above. Plus, law firms love good writers.

2. Join Moot Court, which is a competition of appellate advocacy. Students who are invited to participate in moot court (generally through a try-out process) prepare appellate briefs and then engage in oral arguments before a panel of senior moot court members who function as appellate judges. This is a wonderful experience in terms of developing appellate brief writing and research skills and a great chance to get over any nerves you might have about public speaking. Do well enough and you can compete for your school's national moot court team and then participate in really high-level competition. While I would say that moot court ranks below law review from a law firm's point-of-view when hiring, the experience is completely different and in certain circumstances, if you had to choose between one and the other, moot court might be your better choice. For example, say you know you want to be an appellate attorney and you're gunning for a position with the appellate defender's office. If you can also do moot court, in addition to writing for law review or another law journal, all the better, though most would find this pretty overwhelming, especially when you consider that you still have your classes to study for.

3. Interview during fall recruitment. Each fall, second year law students participate in the most important recruiting time of their career. Fall recruitment is when second year law students interview for the all-important second year summer clerkship, the gateway to being offered a full-time position after graduating from law school. If you land a summer clerkship with one of the top law firms and do well, come your third year you may not have to interview at all with anyone else because you will hopefully be offered a position with the firm you clerked for. Although, it never hurts to interview with others and see what options exist for you. Remember, competition brings out the best in any situation!

4. Choose your classes wisely. Now that it's your second year of law school, for the most part you have a lot of flexibility of which elective classes you take. Some people focus on subjects that will be tested on the state bar exam (different for each state), while others will focus on an area of interest. If you want to be a litigator or not really too sure if you would like being a litigator or not, enroll in one of the trial advocacy or pre-trial advocacy classes that your law school offers. These are great ways to get litigation experience and insight. Try out a seminar, in which you will have a chance to write a note on a particular subject, which you can then add to your portfolio of writing samples. You may even want to do a judicial internship for credit, which is always a wonderful experience and a boost to your resume. Plus, it never hurts getting a reference from a judge!

5. Keep studying! Law school grades are key and will follow you throughout your entire career, unless, of course you break out on your own and hang up your own shingle. But if you have any interest in working for a law firm or a company as in-house counsel or for the government, and especially if you want to teach one day, you better make sure your grades are top notch!

The Road to Building a Family Law Firm

Family law firms deal with much more than just divorce cases. While much of the practice does tend to deal more with marriage concerns, attorneys involved in such practices involve themselves with all types of issues related to the relatives, including maternity, wills, estates, paternity, and trusts. These lawyers may work for firms both big and small. In this article we will provide information pertaining to the steps involved in becoming part of a successful firm.

Step 1: In order to enter law school, one must obtain a bachelor's degree. Once this has been addressed, many students begin an internship somewhere around their second year.

Step 2: While in school, take courses in family regulation, mediation, estates and trusts, wills, trial advocacy, counseling, pretrial advocacy, and interviewing.

Step 3: Register yourself for the Section of Family Law and the Student Division of the American Bar Association. Subscribe and study Family Law Quarterly as well as Family Advocate to keep yourself up to date to new developments and procedures.

Step 4: Write independent research papers and articles pertaining to various topics surrounding the field. Articles may be submitted to the school's journal as well as other journals who are currently accepting submissions.

Step 5: Begin participation in the Moot Court Competitions. In this way you will be able to better prepare for trials and also be able to gain a better understanding of what the court process entails. In addition, enter the ABA's Client counseling or Negotiation competitions whenever the current issue relates to your line of study. The skills gained from such an experience are all necessary to becoming a successful lawyer.

Step 6: Attend networking events held by local regulation practices to cultivate relationships and network with professionals within the community.

Step 7: Build your resume, outlining your skills, accomplishments, and experience. Draft a cover letter as well.

Step 8: Complete law school. Apply for positions at practices or for clerkships alongside judges.

Step 9: Once the school is through, pass the state bar exam in order to become licensed. Begin practicing it.

Step 10: Attend continued legal educational courses and seminars pertaining to the same.

Step 11: Gain membership within local bar associations working groups and attend workshops.

At this point, you should have all the tools you need to be a success. All it takes is a bit of discipline, hard work, and a whole lot of drive.

Here's a typical LSAT Logic Games question:

Nine housewives - Alice, Barbara, Carol, Delores, Evelyn, Francis, Gertrude, Hillary, and Ingrid - will be shopping at Safeway this week. They may shop on either Monday, Tuesday, or Wednesday. Exactly three housewives will shop on each of these days. The following conditions apply:

1. Barbara will shop on Tuesday.

2. Carol and Francis must shop on the same day.

3. Alice and Evelyn must shop on the same day.

4. Gertrude and Hillary cannot shop on the same day.

5. Barbara and Ingrid cannot shop on the same day.

6. Carol and Ingrid cannot shop on the same day.

If Alice shops on Tuesday, and Carol shops on Monday, which of the following must be true?

A. Gertrude shops on Monday.

B. Gertrude shops on Wednesday.

C. Hillary shops on Monday.

I'm not going to waste all of our time by explaining why, but the correct answer is D (Delores shops on Wednesday). I have neither the patience nor the expertise to teach you how to reach this solution, but if you want to excel on the Law School Admission Test (LSAT) you had better be able to answer any question like that within 30-40 seconds.

Is this really possible? Yes, by seeking professional instruction and taking hundreds of LSAT practice tests, you can master the LSAT Logic Games.

Which brings us back to the question posted in the subtitle: How can this have anything to do with law school?

Well, I don't have any inside information, but the LSAT in general is designed to address skills and abilities that are considered vital for success in law school (note, not in the legal profession). The Logic Games section in particular addresses the prospective law student's ability to comprehend complicated factual scenarios, analyze arguments and reach reliable conclusions - largely by elimination weaker positions.

I can attest that these skills are indeed important to your law school success. Obviously, facts like those in the question above have nothing to do with law school or legal practice. The intellectual ability to deal with such situations, however, is absolutely necessary.

The thing about law school, and the LSAT, that is fortunate for those of us who may be less-than-brilliant, is that everything you need to know is in the question. You don't need to know the quadratic equation, the elements in the periodic table or any other background information. You must simply analyze the information you are given and reach the best conclusion.

The practice of law is very similar, but we'll get to that in a few years...

Of course nothing is forgiven for free, but this is a pretty nice way for individuals to provide their skills and services for needed areas of the community, and in return the Government will be kind enough to waive a chunk of their student loans. I meant to say, the government will shine one ray of kindness only if you sweat and bleed for them, I'm just kidding.

When individuals decide on "Forgiveness" and they take on a public service role, it is crucial that they decide on doing this from the goodness of their heart and not for the sole purpose of getting relief on their student loans. A person should find a program that is interesting to THEM, and should consider if it is something that they could have passion for. By thinking it through and deciding on something that suits them, they would be able to serve humanity and at the same time it will allow them to receive assistance on their student loan debt.

I went to School to Practice Law

Tons of people are facing debt because they attended law school. These loans that they acquired from these institutions are comparable to mortgages when you think about the amount of student loans they have taken out. Some are hoping to get scooped up by a fantastic law firm, and through this they hope to pay off their mounds of tuition debt. The truth is, for a significant portion of these students it will not pan-out.

Individuals that practice law should look into working for non-profit organizations or other groups that lookout for the interest of the public. Law school is a goal for many soon to be college graduates. Finding out how to get into law school is a process unto itself. Most people think it is all about taking the LSAT exam and scoring well. That is a big part of the process but there is a lot more involved then just the test. Law schools want to know what kind of person you are and how dedicated to the program you will be during your time there. This is serious business and they do not want someone to be there that takes it lightly.

Other then the LSAT's part of how to get into law school starts with your undergraduate degree. Schools want to see good grades on that transcript. so the sooner you begin focusing on your grades the better. Law schools require your school transcripts as well as a Dean's Letter and Letter's of Recommendation from teachers and the like. The letters must show that you are a dedicated person who works hard and has a desire to go to law school.

Deciding which law school to attend is also a big issue. The best advice would be to have a short list of schools that you would like to apply to and also do not get stuck on a known name school. Keep your options as open as possible and apply to a few schools to give yourself an increased chance of getting in. Not every school is right for everyone and you will need to do some research to find schools that feel right to you.

Law School: Yes, It's Worth It!

"Why are you're here?" was the question I heard a lot in law school, from fellow students and professors.

It seemed like a mystery that an already successful consultant--someone who was prominent in his field and even did frequent "Phoners," guest appearances via cell phone with radio stations worldwide from the school's parking lot--why would he NEED a law degree?

To placate them, I'd tell them that I wanted the knowledge for defensive reasons, to protect the intellectual property rights I was accumulating at a fast clip with my books, audio and video programs, seminars, and other media.

Partly true, that wasn't the only reason, though technically I suppose it was one of the best.

I wanted the law degree largely because I wanted it.

It was a mountain to climb, and having finished a Ph.D. seven years before that, I was itching for a real intellectual challenge.

I got what I had bargained for. Pursuing my consulting gig and attending classes was a real challenge. It meant restricting my clientele largely to west coast companies.

I finished the program, early as it turned out, and I was the only person to walk through graduation having already passed the bar exam.

Soon after that, I was asked: "Was it worth it?"

In today's dollars, I was out of pocket more than $150,000, and I had foregone some lucrative consulting engagements that could have brought in a lot more. Pegging the true cost of the experience at about $750,000-$1 million, that "value" question loomed large.

Was it actually worth it?

The answer is yes.

Doing a little self-lawyering, I recouped my tuition within a few short years. Armed with the knowledge, I undertook even larger consulting engagements with fully open eyes about the risks versus rewards that were involved.

But most important, I realized a dream, an aspiration that was suitable for me. I proved something to myself; broadened my outlook and abilities, and boosted my self-confidence.

Along the way, I've helped some other people, as well.

If you decide to go to law school or to any graduate school, you'll probably ask yourself many, many times, as you're bogged down with interminable homework, "Is this worth it?"

Money aside, if it's what YOU want to do, of course it is!!

Many people hire a wedding planner, but no one thinks to plan a divorce which is more complex. What happens is predictable. No plan, no goal, just money down a rabbit hole. Money to the lawyers, lost custody battles, lost assets, and lots of surprises.

People come to me miserable and complaining about their lawyers and how their case is falling apart. What do I hear the most?

Losing custody to abusers

Losing money to spouses who hide assets.

Spent a lot of money and see no results.

Talked into expensive referrals to therapists, accountants and others.

The attorney is too busy to talk.

The attorney missed a deadline or didn't do discovery.

Ignored by the attorney.

Verbally abuses them.

Threatens to quit right before a trial or hearing if more money isn't paid right away.

How did it get to this point? You felt so comfortable in the first meeting. The attorney promised you the moon and you felt so taken care of.

The problem is this: divorce has become a cash cow as it has become increasingly popular and complex. It has become so expensive that half of the divorcing population can't even afford an attorney and are forced to represent themselves. The attorneys often come from other specialties (often personal injury) because they hear how much money they can make in family law. Family law isn't taught in law school, these attorneys are learning on the job. Worse, they don't know anything about finances and complex issues with stocks, corporations or even a family business. They don't know where to look for hidden assets, and if they do, they don't know how to litigate in this area. Women are often unschooled in finances and the power imbalance of the economic situation forces them into a situation where they leave a lot of community property money on the table.

Is every attorney a bad one? No, and if your case is simple, almost any attorney can walk you through it. The problem arises with more complex cases. Even family law "specialists" are no guarantee of competency, though their ads might make you think otherwise.

Don't look for A Rating in attorney ranking books. They are useless. Your friend's attorney may be a place to start but each case is different, his or her attorney may be incompetent in your case.

"It can sometimes take an attorney to size up another attorney- and the weak ones out there are legion - and the "certified" ones can be certified idiots - unfortunately." Those are words from a litigator who assists people in choosing attorneys. He brings skills from his background to help others identify a good attorney. A 'good' attorney has a goal for your case based on a thorough understanding of the issues. A good attorney knows when to negotiate, when to fight and how to do it so you don't spend all your money doing so. If he doesn't know something, he is REQUIRED by law to tell you - and help you find someone who can. Don't wait until you have lost to find out that your attorney didn't know and didn't tell.

Plan your divorce more than you planned your wedding. Begin by outlining the issues in your case. Be able to say, in 25 words or less, what the issues are. Attorneys like brevity, and charge (a lot) for chatterboxes. Interview different attorneys and look for someone who thinks linearly. You have a goal and if you end up in a "process", you will come out "processed". That is not what you want. You want clear thinking, strategy thinking people on your case that have the time to work on it. This may not be the big fancy firm with the oriental carpets and a view of the city. If the attorney has no time for you, who are you paying? The paralegal?

Divorce is expensive and emotionally distressing. Who do you want on your team? If you chose the wrong one, GET RID OF HIM. You may be told, "it won't look good to the court." The attorneys I know and trust respond, "The court doesn't care, get the attorney you need." If your gardener kills your plants do you keep him on the job? Of course not. Isn't your divorce more important than the plants?

The skill set you need from an attorney may not be how to fill out forms. It may be asset management skills, financial analysis or an understanding of how to handle the abuser in a custody battle. Learn from someone who knows how to determine what your needs are and match that list with the attorney's skills.

Remember: Goal oriented, not process oriented - and every play has to be made towards the goal. Keep focused, objective, and cut your losses if you have to, but keep moving. You want to get out, get to the other side and you can't do that if your attorney is holding you back.

What is The Industry Standard When Negotiating Sales Commissions?

One of my readers, a commission salesman, sent me a question the other day that I've been asked several times:

What percentage is the industry standard when it comes to negotiating sales commissions?

I'll share with you my response to him, and I hope it gives you some guidance as to negotiate compensation.

Your sales commission is a truly negotiable item and just as there are
no "standard" contracts, though every stationery store
sells documents that have that header, there are no
hard and fast rules regarding straight commission compensation.

I have seen 20% a great deal, but this will vary based
on a lot of factors:

How well known is the product?

What is the profit margin?

How long does it take to make a sale?

How difficult is this item to sell?

Here's a commission plan that really worked for me as a salesman, and you might want to negotiate the same sort of scheme.

During graduate school I sold ball point pens, two gross at a shot over the phone.

I "bought" the pens from management at something like
16 cents and sold them for 33 cents. This was a "keep
all over" commission plan, so I could choose to sell
pens at any price I wished. My upward limitation was
the 49 cents engraving at the top of each pen's
barrel.

I made great money this way, and the house got its
price, too. It was a win-win commission arrangement.

But with any plan you need to be careful, especially if you're selling for someone else. Make sure
SOMEONE ON STAFF NOW is making great money and ask that
person to confide in you, telling you: (1)
Management pays on time, and (2) Management has no
history of cutting back on the commission structure.

Also, make sure that management does not keep more
than a 10% "reserve" against charge-backs, if they
compute them, at all. Also, it needs to be explicitly agreed that funds that accumulate in a
charge-back reserve are yours, released to you at a
definite point in time, i.e. 60 days after sale or
upon receipt of payment from the client.

Jim Morrison, of The Doors, Strange and Controversial Death

Jim Morrison was born James Douglas Morrison on December 8, 1943, in Melbourne, Florida. His father was an Admiral in the United States Navy. His family moved around due to his father's job and position in the Navy. Morrison's father was a strict authoritarian figure. Perhaps this had an influence on Jim Morrison's rebellion that he reflected later in his music. Jim Morrison attended St. Petersburg Junior College and Florida State University, both for a year. Morrison then moved to the West Coast to study film and theater at UCLA in 1964.

He became obsessed with the poetry of William Blake and the writings of philosopher Frederich Nietzsche. He gradually lost interest in school and drifted away to finally write his own poetry. Morrison soon began experimenting with drugs, particularly LSD. Morrison impressed several people at that time and decided to form a band. Two of his band members were recruited from the Psychedelic Rangers. Robbie Krieger and John Densmore joined Morrison and The Doors was created. The name was Jim Morrison's idea. He got the idea from The Doors of Perception, from Aldous Huxley's book on mescaline.

Jim Morrison began his singing career fairly shy as a front man. He would avoid eye contact with his audience and sometimes sang with his back turned to the audience. He soon came out of his shell and began performing as the Jim Morrison we all know.

The Doors rose to stardom in 1967 with their debut that began a string of hit songs and headlines in the news. Morrison's anti war antics were loved by many, but hated by some. Especially, due to his father's position as an Admiral in the U.S. Navy. In fact, Jim Morrison was closely watched by the United States Government because he was related to a figure of a high status the US Government. His relationship with a US Admiral, his father, made him a "potential threat" to US intelligence at the time.

Jim Morrison was also known for drunken outbursts of behavior with frequent loss of his temper. He began performing with erratic messages to include profanity and innuendos of sex, to provoke frenzied reactions from his audience.

Law enforcement officials were frequently seen at concerts and often arrested Morrison on obscenity charges, which were usually later acquitted. The Doors also retreated into the studio, where they created works like LA Woman and the hard rocking Morrison Hotel. Morrison often retreated to Paris to unwind and write poetry.

Jim Morrison founded Zeppelin Publishing Company with the help of the legal department of Warner Brothers Pictures and Atlantic Records. Jim Morrison was also known for his very high IQ. Perhaps this was another reason why he was considered a potential threat to US intelligence. Interestingly, Morrison founded Zeppelin Publishing Company right before the rock band Led Zeppelin became famous. At the time, everyone knew who The Doors were, but Led Zeppelin was not well-known yet. Zeppelin Publishing Company was chartered, only to be shelved and later revived.

Jim Morrison encompassed a baritone voice that was dark and erotic. His poetic lyrics along with his voice, helped skyrocket The Doors to be one of the most talked about, controversial, and theatrical acts of our age.

Their popular hits of the 1960s included Light My Fire, Hello I Love You, Don't You Love Her, and many more. On March 1, 1969 Jim Morrison and The Doors were booked for a concert in Coconut Grove, Florida. Morrison's flight was held over in New Orleans, and he spent much time in the airport bar, drinking heavily.

By the Time Morrison arrived on stage, he was barely able to stand. In front of the screaming crowd of over 13,000 people, Morrison briefly exposed himself. Law enforcement officials were pressured by Miami area residents to issue a warrant for his arrest. Morrison later turned himself in to the FBI and went on trial on August 12, 1970.

Jim Morrison eventually withdrew from his own band to write poetry in Paris. He increased his drug and alcohol use, and was found dead in his bathtub on July 3, 1971. He was said to be the victim of an apparent heart attack. He was only 27 years old. Jim Morrison was then buried at the Pere-Lachaisse Cemetery, in Paris.

There is much controversy over his death because of the surrounding circumstances at the time. Following his death, there was a series of bizarre and strange events. People call them strange coincidences. For example, there was a three-day news blackout in the media. His death was not reported until the funeral was over. Robert Hillburn of the LA Times wrote about Morrison's obituary. He titled in article "Why Morrison -- News Delay?". He ignited a controversial spark that since has not dimmed.

Since Morrison's death, there have been rumors and myths of Morrison being spotted in strange places around the world. The most likely place he would be is Paris, France. However, there have been stories of sightings of Morrison, and even claims that he may be living in the Pacific Northwest. He is said to own a ranch there, and living peacefully in seclusion.

As highly unlikely it is for Jim Morrison to still be alive, stranger things have happened in our history. It certainly sparks the imagination of this Doors fan, and other music lovers around the world.

Get a Snapshot of Your Finances

Let's say that we want to take a short weekend vacation to San Francisco. If we were planning to drive and don't know how to get there, there is one key tool that we cannot do without: a map.

To use the map, there are two main questions that we will ask ourselves: (1) Where are we now? and (2) Where do we want to be? After answering these two questions, we can use the map to answer a third question: How will we get there? We then look at the map to find the best route to take to reach our chosen destination as soon as possible.

In the same manner, we need to apply these three big questions to our financial lives. We need to carefully analyze and reflect upon our current financial positions. Then, we should consider where we would like to see ourselves in the future. Lastly, we will create a map that tells us the best way to get to our goals.

Today, we will look at the first question. Later, we will look at the second and third questions.

Where are we now?

Although many of us are in denial about certain parts of our financial lives, there is always room for improvement. Some characteristics of our spending habits are very obvious, while others are hidden. The only way to make this work properly is to bring everything out into the open.

This is particularly true for spouses. We cannot expect our households to run smoothly if we are keeping financial information from our spouses. Whether good or bad, now is the time to mention everything so that nothing is left off of the financial map.

The critical step that will help us determine where we are now requires us to create four lists: the first two lists tell us what we OWN; the last two lists tell us what we OWE.

What do we OWN?

The first list of what we own is a list of our assets. This list includes everything that we have been able to save and/or acquire. This would include all banking accounts; personal investment savings and retirement accounts; equity in our homes and vehicles; and the resale value of some personal items.

The second list is a list of our sources of income, such as jobs or pensions. We would also include social security or disability income, as well as other sources, such as child support. Any money that is coming in would be listed here.

What do we OWE?

The first list of what we owe is a list of all debts and expenses. Every dollar spent should be accounted for, including those quick trips through the drive thru or the coffee we pick up on the way to work. We may not have actual figures for every expense, so it is OK to guess at this point. However, it would be good to start tracking spending habits so that the list can be correctly revised later.

The second list is list of irregular expenses. This list is designed to help us identify those irregular payments that we make throughout the year. Examples of this would be our home's property taxes (if not impounded) or the gifts we purchase throughout the year.

These expenses are often the budget busters that throw everything off when not planned in advance. Since they require large amounts of cash within a short period of time, an entire paycheck may disappear at once.

This list should help us avoid that problem in the near future. To help us prepare for those often-unexpected surprises, we should estimate the costs of these expenses. We then divide the total by 12 to get estimated monthly costs so that they can be included in our regular budget.

Completing these four lists can be an eye-opening experience. Although we pay our bills every month, we seldom take the time to add up all of our expenditures. When irregular expenses are included, our totals get even higher than we had realized. But the whole point of this exercise is to get a true idea of where we stand financially so that we know how to move forward to reach our goals.

Help Children Learn Money Management Skills

One of our main roles as parents is that of an educator. While there are many things that we allow our children to learn about at school, we know that money management is not a priority at most schools around the country.

With that in mind, it is important that we play an active role in helping our children develop the skills that they will need to be financially sound adults. This is not a skill that can be learned overnight, so it is imperative that we start to apply these principles to their lives early. Consistent practice will lead to developing good habits.

Proper divisions

Our children should know how to divide any money they receive into three categories: tithes, savings, and spending. If we show our children how to tithe off of their $1 bills, it will be completely natural for them when they start earning $1,000 paychecks.

We should impress upon our children that God is the source of all of our increase. It is only right to return to Him His tenth. We can also use the opportunity to teach them about helping those who are less fortunate than them. This can include donating money to a particular cause or giving away toys and clothing that they no longer use or need.

Our children should also put aside a portion of their earnings for savings. They can create both short term and long term goals that they would like to accomplish, such as saving for a special toy that they'd like to buy or saving for their own college education. Learning to save well in advance may keep our children from getting into pitfalls like debt.

Allow them to earn

We cannot fall into the trap of giving our children everything that they ask for. I have personally seen the disasters that result. These children are much more likely to grow up to be irresponsible adults who expect everything to be handed to them. They may place a high value on materialistic things and look to these items to create a sense of self-worth.

Rather than giving our children everything they ask for, we should develop some type of allowance system that teaches them the value of money and helps them learn that they must earn the things they want.

Many children have a misconception about money. The ATM machine will not dispense money to us if there is none in the account. They don't fully appreciate that we go to work every day to earn the money that buys the things they ask for.

For example, children may not fully understand the difference between a $20 CD and a $200 video game system. A gift is a gift to a child; the price is often irrelevant. As parents, we have to help them distinguish between the two.

If, for example, the child's allowance is $20 a week, they will quickly learn how to budget their money. They will see that while it takes one week to get a CD, it may take 10 weeks to get a new video game system. Our children will have a greater appreciation for the things we give them, and they will be more selective in the things they ask for.

The sooner we start teaching these very important skills, the better off our children will be when they have to face real world financial issues without us.

College Packing List: What You Should Bring to School

Making the decision to go to school and actually find the right school to attend has probably been overwhelming. But you have finally made a decision and are in the process of getting things together for school. If you have been thinking about what you should bring with you to college, then the following will give you some in sight on what you should include in your college packing list.

The first thing that you will probably start packing is your clothing. You might want to bring all of the clothes that you own. But you should be aware that some schools require that you move all of your belongings from the dorm at the end of each semester. So you should limit the amount of clothing that you pack.

You will also need to bring toiletries and personal items. Toiletries would include items like a toothbrush, toothpaste, and deodorant. But you will also probably want to bring shower shoes (flip flops), a bathrobe, and a bathroom caddy. Many dorms have community bathrooms, where there is one bathroom that is centrally located on each floor. You would want the shower shoes to prevent your feet from getting in contact with the shower floor since other people may have conditions like athletes foot. The bathrobe is to keep you covered as you travel down the hall. And the bathroom caddy makes carrying personal items between your room and the bathroom easier.

Since you are going to school, you will want to bring school supplies. This would include items like a backpack, paper, pens and binders. You might also want to bring a computer so that you do not have to deal with lines or a time limit at the computer lab.

Each dorm will usually be furnished with at least a bed, closet, and a desk with a chair. But you may want to bring some items with you to make the room comfortable so that it feels a little more like home. These items might include a lamp, rug, and possibly some curtains.

Acting, like any other craft, is two parts natural talent and one part education. Searching for just the right school can take some time and dependent upon what you want to learn, is also a subjective thing. Among those "to die for" drama, music and art schools, there are some which clearly and consistently outperform the others when it comes to putting out famous personalities.

Clearly belonging in the top ten acting schools are the following:

1. Julliard School. Located in the heart of New York City, attending Julliard is a dream for those who want to perform in theatre, dance or music. The criteria for admission to Julliard are a great deal more stringent than many other schools. Audition is required prior to entry and each year thereafter to remain with the program. Of more than 2000 applicants each year, they select about 8.

2. Yale University. An internationally recognized arena for visual and performing arts and the possessor of world acclaimed Schools of Art, Drama, and Music. Distinguished former students of Yale include Paul Newman, Meryl Streep, John Turturro, and Sigourney Weaver.

9. UCLA School of Theater, Film, and Television. Located in Los Angeles California, the entertainment capital of the world, it draws on leaders of the industry for instruction. UCLA School of Theater holds the distinction of being the only university in the country where the studies of live theater, film, television, is integrated with that of digital media manipulation within one single teaching arena.

10. Acting School of South Florida. The school is famous for placing emphasis on acting training given to aspiring actors to prepare them for the real job. Most teachers here are former actors that have decided to share their talents and experience to those who would like to act.

When choosing a school of the performing arts, we should bear in mind that some of those we apply to will be filled, or will deny our application. Probably the best way to apply will be to choose one or two of those you don't feel you will be accepted to, but would love to attend. Students often times do not write anything down when the teacher or professor does not write anything on the board. You have to listen and write key points down. At the end of everyday go back and review those notes to make sure they make sense. Re-write any notes that need clarification or notes that do not make sense. reviewing your notes at the end of everyday will save time when test preparation times rolls around.

Another tip is to highlight your textbook instead of underlining. Studies have shown that high lighting is a more effective way of memorizing the material. Instead of high lighting just key words and terms focus on high lighting key phrases and important material. Of course this does require you the student to read the chapters.

It was Charles Dickens who stated in his famous novel Oliver Twist, "the law is an ass," and perhaps in some instances we would have to agree with him. However, what is even more alarming is when judges are bigger asses when they exhibit judicial bias or they abuse their wide discretionary powers that is accorded to them within the family court system. They may even, in certain instances, look the other way when there is a question of attorney ethics. All of this leads to a violation of due process that every citizen is entitled to under our democratic legal system. Such denial of justice was experienced by Ellie Boatman Conger, principal protagonist in Ellie Boatman's debut novel, Unbridled Injustice.

Many authors have turned to fiction to provide a beacon of enlightenment in understanding bitter struggles during dark times, and Boatman is no exception, as she uses this genre very effectively in narrating how one woman from Kentucky had been wronged by the judicial system.

Set against Lexington Kentucky's equestrian community, the novel tells the story of Ellie, who after vacationing for a week in Florida with close friends, arrives home at the airport only to be greeted with a divorce petition from her husband Roy. This comes as quite a shock to a woman who believed that life could not be sweeter. After all, she had three great children, a successful husband, a gorgeous home and farm that included several prized ponies, and the respect of her hometown social community.

However, all is not as it appears and as Ellie asserts, "sometimes our lives are like sleepwalking. When we finally awaken we have no idea where we are and even less how we managed to get there."

Shortly after receiving the divorce petition, Ellie finds herself embroiled in very nasty and costly judicial proceedings that could mean the loss of custody of her children to her husband. To further aggravate this frightful situation, Ellie regrettably engages a young and inexperienced attorney, who was not too swift on his feet and consequently is outmaneuvered by the unethical tactics and devious behavior of his opponent, who uses every trick in the book to make life miserable for Ellie. Adding a little more drama into the narrative is the grotesque possibility of child molestation that is ignored by a judge, who has her own agenda, and a lazy social worker assigned to the case.

For a first time author, Boatman shows a great deal of confidence in her story- telling abilities, although at times the pony show scenes wear a bit thin, slowing down the pace of the novel. Nonetheless, this hard-hitting narrative is a page turner not only because of its plot, but also the strong message it conveys. Conger gets top marks for her clarity and richness of voice, all of which contribute to the reader's ease in empathizing with Ellie's anger and despair, as she fights the sometimes unfairness of the judicial system in order to gain the custody of her children. In the end, does justice prevail?
