There is this idea that knuckleheaded cold calling is difficult.

What makes it so?

It is the fact that you are sitting in an office with air conditioning, or room in which it owns 100% of air pollution?

It is the fact that talk about your only significant physical exertion and dial-up?

It is the fact that little scour 'of mud to find gold nuggets, patches promising gold dust that can bring the Mother Lode?

It is the fact thatTheir self-importance is dinged a little, 'as' poor (secretaries and other officials of the screen the calls, especially for its script standard should be better than one on your shiny?)

It is the fact that many are quick to say no, you can save a lot of time that are in follow-up, if they were not direct the waste?

It is the fact that you can not see, so you can super-casual dress and put the boots on the desk or look like a rock star, ifthat's your style?

It is the fact that if you are successful, you are well paid and treated as if you are walking on water?

All these dangers and pitfalls, frustrations and setbacks are you?

Then you're a baby crying, not only do not realize:

(1) The phone is the fastest way to build your business, unless you have tons of pasta, probably managed to acquire another company, whose founder, by "cold calling" way back when they started to use.

The Recession of 2008 Will Make Consultants & Coaches Wheelbarrows of Dough

It was more than a decade ago, and I was visiting a franchisee of a well known, publicly traded executive search company.

Through an odd confluence of factors, I was pitching the president of the Los Angeles branch, who asked me, more or less, "Why are we having this meeting?"

That's never an auspicious start to a consulting relationship; that much I can tell you. When prospects don't feel a burning need, we don't need to go much farther.

The conversation got even worse after I replied, "To make you some money."

"Why, we're taking WHEELBARROWS of money to the bank, so why would we need your help?"

That's the sort of arrogance that good times bring...and it's nearly impossible to buck.

Soon after that, we entered a deep recession. Real estate prices dropped 20% in many upscale towns, money grew tight, and there seemed to be no end in sight to the economic woes.

And of course, that same recruiting firm became a hollowed out shell, firing people in droves, singing the blues.

Sound familiar?

If not, it could very, very soon. According to some economists, we entered a recession in December, 2007, and things are going to look gloomier before they brighten.

And that's precisely why it is the best of times to be a corporate consultant or coach. When the going gets tough, and it will, large and small companies, alike suddenly get uncharacteristically humble and open to outside ideas.

As consultants and coaches, we can't ask for more.

So Sue Me, JACKASS! by Amy Epstein Feldman and Robin Epstein is a book that will answer all the legal questions you've been afraid to ask - no matter how outlandish they may be - and it does it in a practical, easy to understand and humorous way.

Amy is a nationally syndicated legal columnist and general counsel for The Judge Group, Inc., an international business solutions provider. She's been asked every question you can imagine and then some. Friends, relatives and employees go to her for a multitude of reasons, not the least being she doesn't charge them $200 per hour for a consultation. Her sister Robin is an author, stand-up comic and former sitcom writer. She convinced Amy she should write a book - that it would be incredibly useful for people who don't have a relative who's a lawyer. Robin is a television writer but she shares a love of the law with her sister. Together they wrote So Sue Me, JACKASS!

The book is divided into topics and written in a question and answer format that is easy-to-use and fun to read. The sisters offer sanity-saving legal advice that entertains while giving you peace of mind. I was hooked as soon as I started reading Chapter 1: Your Job - Hi Ho, Hi Ho, It's Off to Sell Your Soul to the Devil You Go! Amy answers such questions as - Is it illegal to make people work on National holidays? The short answer is NO. Or how about - Do you have any rights when it comes to a smelly coworker? Well, it depends where you work. The sisters offer some practical advice in case your town doesn't have an official policy for stinky employees. Boy, I could have used some of this advice in my previous life as a municipal drone. But even if the questions don't pertain to your life they're still informative and entertaining. The author's stories and humor make them a hoot to read. It's useful and fun and highly recommended.

There is a disclaimer. This book is not meant to be a substitute for getting your own lawyer should you need one. As Amy says "Let the very first piece of legal knowledge I bestow be this: He who acts as his own lawyer has a jackass for a client."

Don't You Ever Call Me Again!

It was a Friday morning and I was already looking forward to the weekend, despite the fact that I sold for Time-Life on Saturday mornings, too, from 9-1.

As usual, I was moving down my list if prospects when I saw a fellow's name, nothing odd about it. I dialed and smiled, and began my pitch.

He may have offered some initial resistance--most people did--but we were undaunted, realizing that more than 50% of our sales would come from folks just like him, who offered a single interruption and then relaxed and bought.

This fellow, I'll call him Earl, didn't simply say he wasn't interested once or twice. He yelled, and I mean this hurt my eardrum, "Don't you ever call me again!"

Please believe me when I tell you I was utterly polite and professional, so this concussion bomb was completely new to me, and uncalled for. Weakly but quickly, I apologized and let him go on his way.

By Saturday, I had mostly forgotten about this guy as I scanned my list for names to call. I saw a guy whose name hadn't been crossed out, and as was our procedure, I phoned him.

After saying hello, my heart sank, and I thought, "Oh my gosh, I've done it now!"

Without realizing it, I called the same guy, Earl, after he told me to never call again!

But I had already begun my presentation, so I couldn't just stop; I had to march on, which is what I did, all the while believing he would bring a bullhorn to the line and retire my left ear, permanently.

Eerily, I progressed from one part of the chat to the next, finally getting to the close.

"Ah, this is where he'll blast me" I thought.

Still, I persevered, "So, let's get you started with this library and I know you'll be pleased, Okay?"

And he replied, "Okay!"

I confirmed the order, delivery date, and other particulars, to my utter astonishment and disbelief.

This happy accident taught me a lesson.

Someone who vociferously says no today, could enthusiastically say yes, tomorrow.

So, don't prejudge those prospects of yours. It's like that story of the three kinds of baseball umpires.

The first says: "There's balls and strikes, and I call them the way I see them."

The next says: "There's balls and strikes, and I call them the way they are."

And the third umpire wisely states: "There's balls and there's strikes but they ain't nothin' until I call them!"

Ditto for sales prospects: They aren't anything until we call them!

UK University Rankings - A Comparison

Which is the best ranked university in the UK? How are universities performing? There is no official government ranking of universities in the UK. However, there are some newspaper rankings published every year by the Times Newspaper, The Telegraph,The BBC's Student Guide, The Independent University Guide and The Guardian.

Oxford is ranked as the Number 1 University by The Independent and Guardian, outperformed Cambridge in 2008. Oxford tops the Guardian league table, followed by Cambridge, London School of Economics, Warwick, St Andrews, Imperial, University College London, the School of Oriental and African Studies (SOAS) and Edinburgh.

There are several university guides in the UK which rank all universities in order of merit, but based on different criteria. Guardian focuses on the quality of teaching and what students themselves think. The Independent Good University Guide (now The Complete University Guide) uses nine measures of quality - student satisfaction, research assessment, entry standards, student/staff ratio, library/computing spend, facilities spend, degree classifications, graduate prospects, and completion rates. All universities are assessed in these nine quality factors. It is a highly regarded university guide; students often make a reference to the ranking tables when choosing a university. There are 59 subject tables which rank the universities within individual subjects.

However, a university which ranked highly in The Times may appear in a poor position in other university guides such as the Sunday Times or the Guardian. In 2008, there are some big differences in ranking positions among the two famous university guides (Guardian and The Independent), such as the follows:

(1) University of Dundee is ranked 17 in the Guardian (A Top 20 University), but it is ranked 52 in The Independent, even not in the Top 50!

(2) University of Bristol is ranked 31 in the Guardian (outside Top30), but it is highly ranked in The Independent, at 16.

(3) Anglia Ruskin University is ranked 109 in The Independent, but it is in a higher position of 71, in the Guardian league table.

(4) Thames Valley University is ranked 85 in the Guardian, and 110 in The Independent.

(5) University of Durham is doing extremely well in The Independent, ranked at 6th position, but it is ranked 16 in the Guardian (outside Top 15).

(6) University of Abertay Dundee is ranked 68 in The Independent, but it is outside Top 100 in the Guardian, at 105.

Which ranking guide is the best? It really depends on a number of factors.

Negotiation Tip: Never Say No!

I have been going back and forth, exchanging emails with a potential seminar sponsor a world away.

And while it's very possible that we may never do business, I won't give in to that initial perception.

If I've learned anything in a few decades of professional speaking, management consulting and publishing, it's this:

"There is a way to make every deal!"

Don't get me wrong. If someone approaches me to do a program 12,000 miles away, and expects me to charge only for the single hour or day that the speech consumes, then I'll have to decline.

But I won't really say "no."

I might say, "I'd love to do this program and help you out, but I'm going to need more billable time once I arrive, to justify the four days that will be consumed in traveling to and from. So, if you can keep me busy with paid engagements for a number of days, let's see what we can put together!"

An outright declination leaves them only with a problem: Where are they going to find a capable presenter?

But my response offers a solution. It entices my counterpart to think, "How could we do that?"

In other words, it generates a win-win situation, instead of lose-lose.

This has worked for me, and it has made my hosts very happy.

What's the Difference Between: A Lawyer, Solicitor, Advocate, Barrister, Counselor, and an Attorney?

Have you ever wondered where all these somewhat confusing terms came from? Well the answer is they are all types of Lawyers originated from various legal systems. Some of the terms are from the English legal system, some are from Scotland and some from the American legal system.

An Attorney is somebody legally empowered to represent another person, or act on their behalf.

A Lawyer is somebody who can give legal advice and has been trained in the law.

Are Attorney and Lawyer are synonyms? Basically yes, but they are not necessarily Interchangeable terms, you cannot for instance say I give you the Power of a Lawyer, but you definitely might say I give you the power of Attorney...

Look again at the above definitions, does it now make any sense? Off course it does.

An attorney in fact is an agent who conducts business under authority that is controlled and limited by a written document called a letter, or power, of attorney granted by the principal. An attorney at law is an officer of a court of law authorized to represent the person employing him (the client) in legal proceedings.

A Solicitor- One that solicits, especially one that seeks trade or contributions. The chief law officer of a city, town, or government department but does not act as an advocate in court, as opposed to the Attorney who pleads in court. (English Law).

A Barrister(Called Advocate in Scotland) presents the case in court. Most senior and distinguished barristers are designated King's (Queen's) counsel.

A Counselor at law- In the past at least in some U.S states there was a distinction between the term A Counselor at Law who argued the case in court and an attorney who prepared the case but didn't argue it.

Nowadays an attorney at law is authorized to exercise all the functions of a practicing lawyer. All of them must, however, like the ordinary attorney, be admitted to the bar. The term attorney is also used for county, state, and federal prosecuting officers, as county attorney, district attorney, and attorney general.

Lawyers, also called attorneys, act as both advocates and advisors in our society. As advocates, they represent one of the parties in criminal and civil trials by presenting evidence and arguing in court to support their client. As advisors, lawyers counsel their clients concerning their legal rights and obligations and suggest particular courses of action in business and personal matters. Although all lawyers are licensed to represent parties in court, some appear in court more frequently than others. Trial lawyers, who specialize in trial work, must be able to think quickly and speak with ease and authority. In addition, familiarity with courtroom rules and strategy is particularly important in trial work. Still, trial lawyers spend the majority of their time outside the courtroom, conducting research, interviewing clients and witnesses, and handling other details in preparation for trial.

Lawyers types:

The legal system affects nearly every aspect of our society, from buying a home to crossing the street. Lawyers hold positions of great responsibility and are obligated to adhere to a strict code of ethics.

The more detailed aspects of a lawyer's job depend upon his or her field of specialization and position. Although all lawyers are licensed to represent parties in court, some appear in court more frequently than others.

Lawyers may specialize in a number of different areas, such as bankruptcy, probate, international, or elder law. Those specializing in environmental law, for example, may represent public-interest groups, waste disposal companies, or construction firms in their dealings with the U.S. Environmental Protection Agency (EPA) and other Federal and State agencies. These lawyers help clients prepare and file for licenses and applications for approval before certain activities may occur. In addition, they represent clients' interests in administrative adjudications.

Some lawyers concentrate in the growing field of intellectual property, helping to protect clients' claims to copyrights, artwork under contract, product designs, and computer programs. Still other lawyers advise insurance companies about the legality of insurance transactions, writing insurance policies to conform with the law and to protect companies from unwarranted claims.

Most lawyers are found in private practice, where they concentrate on criminal or civil law. In criminal law, lawyers represent individuals who have been charged with crimes and argue their cases in courts of law. Attorneys dealing with civil law assist clients with litigation, wills, trusts, contracts, mortgages, titles, and leases. Other lawyers handle only public-interest cases--civil or criminal--which may have an impact extending well beyond the individual client.

These issues might involve patents, government regulations, and contracts with other companies, property interests, or collective-bargaining agreements with unions.

Other lawyers work for legal-aid societies--private, nonprofit organizations established to serve disadvantaged people. These lawyers generally handle civil, rather than criminal, cases. A relatively small number of trained attorneys work in law schools.

Lessons in Entrepreneurship - How to Justify an Outright Ripoff

In a recent article I described how tempting and lucrative it can be for entrepreneurs to "steal" a business concept, whether it is producing promotional videos for executives and professionals, opening photography studios, or grilling billions and billions of burgers.

"Creative imitation," a term coined by management guru and my late professor, Peter F. Drucker, isn't exactly theft, even if it seems to be the opposite of originality. It is simply a way of making good better, say those who do this sort of reverse Robin Hood commercial activity.

But how do those that perform creative imitation rationalize it in such a way that it becomes socially acceptable?

I came across an example of this recently in the New York Times fashion section.

Introducing a slideshow of a designer's wares, the Times characterized the entrepreneur this way:
"Seema Anand's firm, Simonia Fashions, makes clothes inspired by other designers."

That's a fairly cool way to say I'm knocking off your fashions. I'm "inspired by them." This taps into the "imitation is flattery" notion, I suppose.

Filmmakers often say they've "done an homage" or a "tribute" to another auteur whose work they have brazenly copied.

In fact, that word "tribute" is getting more play all the time, literally, as in the subtitles of the Beatles tribute bands that are making dough around the world, presumably without paying royalties to the originals, or to whomever owns the Lennon-McCartney songbook along with Michael Jackson.

Speaking of Peter Drucker, since his passing at the ripe age of 95, various authors have emerged claiming to have captured his essence. Yet more fortune seekers form their consulting practices around his precepts.

They call themselves by various names, including "disciples," which I believe the grand master, ever aware of the purity of his "brand," would have chuckled at, to say the least.

Smiling is probably all a proponent of creative imitation could do when witnessing how his own concepts are being creatively imitated. That's what makes this entrepreneurial gambit both successful and puckish.

You can openly steal, get away with it, prosper, and justify it various ways.

It may be the only thing that beats having your cake and eating it too.

How to Prepare for the Law School Admission Test (LSAT)

Entering law school is never an easy thing to do. There is so much to think about and so many changes to go through and steps to fulfill, that it can seem like you will never get there. After all of that, you still have to go through weeks upon weeks of waiting and wondering if you were able to get into the law school of your choice, and the law school admission test may or may not even matter.

The law school admission test is the LSAT and when it comes to the LSAT there is a lot to think about. The exam itself takes about a half a day to complete, and is required by all law schools so there is no getting round the law school admission test. It is designed to measure the knowledge and the capacity of learning of each and every student who applies for law school; so that those who are going through the changes that are required to select people to enter into their law school know that they have only the most intelligent students, fit for being successful at their institution.

There are five sections to the Law school admission test. The questions on the test are multiple choice tests, but only four of the five of these tests contribute to your overall LSAT score. There is a section designated just for reading comprehension, one for analytical reasoning, two for logical reasoning, and a writing sample. In addition, there is a section that is designed just to test new test items and this is the section that does not add to your overall law school admission test score, but you won't know what section this is when you take it.

It is best to make sure that you take the law school admission test before the month of December rolls around. This is the best time to take it in order for the results to be ready and read by the people who take applications at all of the top law schools in the nation, but most people take it in the summer months or the fall months, right as the Fall begins.

If you want to be able to be as prepared for the law school admission test as you possibly can, you should find out just how the test is scored. You don't have to get every single question right, but knowing how to answer the questions and whether or not it is better to leave a question blank or potentially answer it wrong is part of knowing how to take the test.

It is probably best to prepare yourself for the law school admission test by taking a test prep class either in person or on the internet. You can take the law school admission test at any one of hundreds of test locations all around the world.

Inventors, dreamers, innovators and concept designers have a brain optically better, and can create, imagine and almost everything. They are creative geniuses, and we are happy, have in our culture and society. Unfortunately, with this incredible gift, often there is little detail implacable, and the inability to form structure in an environment of legal work, and the filing of patents they need to protect their genius.

He explains the benefits of the patent, the patent if it is financed by the state of research, and discusses the issues of scope of the invention, the scope of the invention and technology. He said that the drawings of the patent, cross-references and alternative uses.

In fact, I have this book in my personalLibrary and use from time to time, and I want everyone that is an inventor or innovator hobby recommend you take a copy and put it in their personal library. I hope you please consider this.
